Adoption by same-sex couples: A comparative analysis of Ecuadorian and international law [Adopción por parejas homoparentales: Análisis comparativo de la normativa ecuatoriana y el derecho internacional]

The aim of this study is to analyse adoption by same-sex couples from a comparative analysis of Ecuadorian and international law. This study was carried out using a descriptive documentary methodology, selecting 12 sources of information from specialised scientific journals. The comparative analysis reveals that Ecuador faces a notable lag in the regulation of homoparental adoption in comparison with other countries in the region and the world, where inclusive regulations based on the principles of equality and non-discrimination have been implemented. While countries such as Argentina, Uruguay and Spain have made significant progress in guaranteeing the rights of same-sex couples and the best interests of the child, Ecuador continues to face legal and social barriers that hinder access to these rights.
