Analysis of habeas corpus and abuse under Ecuadorian laws [Análisis del habeas corpus y el abuso ante las leyes ecuatoriana]

Habeas corpus is one of the most relevant jurisdictional guarantees in Ecuadorian constitutional law. The aim is to analyse habeas corpus and its abuse under Ecuadorian law. It was developed under a descriptive and documentary methodology. Habeas corpus in Ecuador, despite its relevance as a constitutional guarantee for the protection of fundamental rights, has experienced a distorted use that compromises its integrity. The abuse of this figure, especially in its corrective modality, has generated a distortion of its original purpose, which underlines the need for reforms at both the normative and judicial levels. The violation of the principle of celerity and the inconsistent application of habeas corpus reveal structural deficiencies in the Ecuadorian justice system, which need to be addressed to ensure that this tool continues to be an effective mechanism for the protection of fundamental rights, without losing its essence or being manipulated for purposes alien to its nature.
