Analysis of rights and their procedures in the administration of indigenous justice [Análisis de los derechos y sus procedimientos en la administración en la justicia indígena]

Indigenous justice in Ecuador is a crucial area of study within the framework of legal pluralism and the autonomy of indigenous peoples, aspects that are enshrined in the 2008 Constitution. The objective of this research is to analyse the rights and procedures in the administration of indigenous justice in Ecuador. A systematic review was carried out of 12 academic articles published in specialised journals, selected on the basis of their relevance and methodological rigour. The administration of indigenous justice in Ecuador faces significant challenges, especially in the articulation with the ordinary justice system, which reflects inherent tensions in a plurinational state. Despite efforts to recognise and respect the autonomy and collective rights of indigenous communities, legal and cultural barriers persist that limit the full implementation of their judicial procedures.
