Child labor as a violation of the best interests of the child [El trabajo infantil como vulneración al interés superior del niño]

The objective of this review article is to analyze child labor as a violation of the best interests of the child. Methodologically, a systematic review was carried out following the PRISMA guidelines, adapted to legal analysis, selecting 26 relevant studies published between 2000 and 2024. The results show that child labor is a multifactorial phenomenon, linked to structural poverty, social inequality and the lack of access to fundamental rights such as education and social protection. In Ecuador, this problem affects both rural and marginal urban areas, aggravated by the inadequacy of public policies and the normalization of this practice in certain communities. It is concluded that a comprehensive approach is needed that combines effective public policies, family empowerment, community awareness and regulatory oversight to guarantee a childhood free of exploitation and promote its integral development.
