Abstract

The regulation of biotechnological and genetic advances in Ecuador, from a criminal law perspective, faces the challenge of balancing scientific and technological development with the protection of human rights. The objective of the research is to analyse the classification of biotechnological and genetic crimes in the Ecuadorian comprehensive organic penal code. It has been developed under a descriptive methodology with the analysis of 11 academic articles. The classification of crimes related to biotechnology and genetics in Ecuador's Comprehensive Organic Criminal Code reflects a legal framework that attempts to balance scientific advances with the protection of human rights, biodiversity and the country's genetic heritage. While the COIP already includes genetic manipulation as a crime, there are still loopholes such as gene editing through CRISPR and the use of biotechnological technologies in agriculture.
