The victim of rape in cases involving related persons [La victima de violación en casos de personas con lazos de parentescos]

Rape in cases of kinship rape represents one of the most complex and devastating forms of sexual violence, not only because of the seriousness of the crime itself, but also because of the profound emotional, psychological and legal implications that it entails. In accordance with the above, the aim of this study is to analyse the legal context of rape victims in cases of people with kinship ties. The design of the study was bibliographic in nature, based on the compilation and analysis of 11 academic articles. Rape in kinship contexts presents unique challenges that require a comprehensive response from the legal system, highlighting the need for policy reforms that address the particularities of these crimes. The emotional and psychological complexity that victims go through, coupled with the betrayal of intra-familial trust, underlines the urgency of criminalising incestuous rape as a stand-alone offence.
