Incidence of international criminal law on domestic [Incidencia del derecho penal internacional en el derecho interno] law

The purpose of this research is to analyse the impact of international criminal law on domestic law. Through documentary review and theoretical methods (analysis-synthesis, historiological, inductive-deductive, abstract-concrete and focus-system), the challenges of harmonising international standards with due process guarantees are examined. The adoption of treaties such as the Rome Statute requires the reform of legislation and strengthens universal jurisdiction, ensuring the prosecution of acts that threaten global peace. However, tensions arise in relation to state sovereignty, the principle of complementarity and the adequacy of procedures. Greater cooperation, specialised training and regulatory adjustments are required to apply international provisions without violating fundamental rights or the autonomy of each system. This study reaffirms the relevance of international cooperation in strengthening global justice and avoiding impunity.
