Seguridad jurídica en las contravenciones por conducción en estado de embriaguez [Legal certainty in drink-driving offences]

In Ecuador, drink-driving is one of the main causes of traffic accidents, which has led to the strengthening of the regulatory framework. The aim of this article is to analyse the legal security of drunk driving offences in the context of Ecuador. The article was developed through a legal documentary review, the selection of the documentary population included 12 scientific articles. The lack of uniformity in the interpretation of malice aforethought and state of necessity, together with the limited consideration of criminogenic factors, reflects a gap between regulations and their effective implementation. Improved forensic procedures and the adoption of stricter drink-driving prevention and control policies are essential to ensure a fair administration of justice based on principles of proportionality.
