Parental responsibility and child protection: A comparative analysis for implementing shared custody in Ecuador [Corresponsabilidad parental y protección infantil: Análisis comparado para implementar tenencia compartida en Ecuador]

The objective of this research is to analyse parental responsibility and child protection from a comparative perspective in order to implement shared custody in Ecuador. A qualitative methodology with an exploratory-descriptive approach was used, with a documentary analysis of legislation in Spain and Argentina, where this model has proven effective. The sample included the Ecuadorian Organic Code on Children and Adolescents, the Spanish Civil Code (Article 92) and the Argentine Civil and Commercial Code (Article 650), complemented by empirical studies on implementation and effects. The results show that in Spain and Argentina, shared custody has reduced parental conflicts, improved child welfare and promoted effective parental responsibility. It was identified that Ecuador lacks specific regulations, limiting equitable access to this custody regime. The legal feasibility of implementing shared custody in Ecuador was confirmed, requiring reform of the Children and Adolescents Code, accompanied by comprehensive public policies that include judicial training.
