The right to health, recognised in the Constitution of Ecuador, constitutes a fundamental pillar of human and social development. The research objective was to describe the right to mental health in Cotacachi, Ecuador. A mixed methodological approach was used. Ninety per cent (216 people) of those surveyed agreed that there are circumstances that violate the right to mental health. Four categories related to access and challenges in mental health treatment were identified. Insufficient public resources, poor integration of mental health services in primary care and dependence on the private sector reinforce inequalities, contravening the mandate of free and universal care. Together with the lack of protection for vulnerable groups such as women, children and older adults, this highlights the lack of a differentiated and gendered approach, in contrast to the state's duties established in article 35.
