RESUMEN
El presente estudio analiza las inconsistencias normativas presentes en el ordenamiento jurídico
ecuatoriano respecto a los procesos de adopción, particularmente en relación con la aplicación
efectiva del principio del interés superior del niño. Mediante un enfoque doctrinal-hermenéutico, se
examina la antinomia existente entre el artículo 316 del Código Civil que establece como edad
mínima para adoptar los 30 años, frente al artículo 159 numeral 4 del Código de la Niñez y
Adolescencia que fija dicho requisito en 25 años. Esta contradicción genera inseguridad jurídica y
prolonga innecesariamente los procesos adoptivos, vulnerando el derecho fundamental de los
menores a contar con un núcleo familiar estable. La investigación evidencia que tales divergencias
normativas constituyen un obstáculo para la materialización del principio constitucional del interés
superior del niño, requiriendo una armonización legislativa urgente que privilegie la celeridad
procesal y el bienestar integral del menor.

ABSTRACT
This study analyzes the regulatory inconsistencies present in the Ecuadorian legal system regarding
adoption processes, particularly in relation to the effective application of the principle of the best
interests of the child. Through a doctrinal-hermeneutical approach, it examines the existing antinomy
between article 316 of the Civil Code that establishes the minimum age to adopt at 30 years, versus
article 159 numeral 4 of the Code of Childhood and Adolescence that sets this requirement at 25
years. This contradiction generates legal uncertainty and unnecessarily prolongs adoption processes,
violating the fundamental right of minors to have a stable family nucleus. The research shows that
such regulatory divergences constitute an obstacle to the materialization of the constitutional
principle of the best interests of the child, requiring urgent legislative harmonization that privileges
procedural speed and the comprehensive welfare of the minor.
